TERMS OF USE

 1. WEBSITE AND TERM OF USE

1.1. These Terms define the type and scope of services provided by the Law Firm electronically through the Website, as well as the terms and conditions of using the Website by the Users (as defined in section 2 below).

1.2. The Law Firm is the owner of the Website.

2. DEFINITIONS

2.1. Law Firm – Jakub Wiewióra running a sole proprietorship under the business name „Kancelaria Radcy Prawnego Jakub Wiewióra”, NIP: 6332222219, address for service: ul. Stalowa 27/43, 03-425 Warszawa, Poland, email: office@jakubwiewiora.com.

2.2. Consumer – a natural person who performs a legal act with the Law Firm not directly related to its business or professional activity, or a natural person concluding a contract with the Law Firm directly related to its business activity, if the contract shows that it does not have a professional nature for that person, resulting in particular from the subject of its business activity, made available on the basis of the provisions on the Centralna Ewidencja i Informacja o Działalności Gospodarczej.

2.3. ODR Platform – online tool for amicable dispute resolutions between Consumers residing in European Union and entrepreneurs having its registered office in European Union, resulting from online sales contracts or contracts for the provision of services, available here: https://ec.europa.eu/consumers/odr.

2.4. Terms – these terms.

2.6. User – a natural person visiting the Website.

3. TERMS AND CONDITIONS OF USING THE WEBSITE

3.1 The aim of the Website is to inform about the Law Firm’s object of activity.

3.2. Using the Website is free of charge, voluntary and available for all Internet users.

3.3. To use the Website, it is necessary to have a device equipped with an ITC system connected to the Internet, standard web browser.

3.4. The User obtaining access to the Website concludes with the Law Firm the agreement on providing access to the Website on the terms and conditions set forth in these Terms. The agreement is being concluded for the indefinite period and automatically terminates when the User leaves the Website. The User may leave the Website and terminate the agreement with the Law Firm at any time and for any reason.

3.5. The User undertakes to use the Website in accordance with the applicable law, good practice, in a way that does not violate the rights of the Law Firm and third Parties, and only for its own personal use.

3.6. The content on the Website is subject of the copyrights protection and may be used by the Users without the Law Firm consent, only based on the basis of fair use.

4. COMPLAINTS

4.1. The User who is not satisfied with the functioning of the Website may file a complaint by sending an email to the following address: office@jakubwiewiora.com.

4.2. Complaints will be addressed not later than within 14 calendar days from the date of filing the complaint. The response to the complaint will be sent to the User by email to the email address from which the complaint was sent.

4.3. The User who is also a Consumer residing in EU may also use ODR Platform available at: https://ec.europa.eu/consumers/odr, which allows for amicable settlement of any dispute resulting from an agreement on providing access to Website made with the Law Firm.

5. PERSONAL DATA AND COOKIES

5.1. The rules of processing personal data of the Users and cookies are set forth in Privacy Policy.

6. FINAL PROVISIONS

6.1. Polish law is applied to the Terms. In matters not regulated in the Terms, the relevant provisions will be applied.

6.2. If any of the provisions of the Terms turns out to be less favourable for the Users than, than provisions of mandatory law in the territory of Poland, in particular provisions protecting Consumers, the more favourable provision for user will be applied.

6.3. Any disputes between the Law Firm and the User in connection with the use of the Website, not resolved amicably, will be resolved by the common court having jurisdiction over the Law Firm’s address for service.

6.4. The Law Firm may amend the Terms at any time. The amendment comes into force when published on the Website, unless it states otherwise. The current version of the Terms came into force on 15 September 2022.
